Effective Date:
Painters of Texas ("we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you use PaintersOfTexas.com (the "Platform"), how we use it, who we share it with, and the choices you have. Please read it carefully. By using the Platform, you agree to the practices described here.
Short version: We collect the information you give us when you request a quote or apply as a contractor, we use it to match you with a qualified partner, and we do not sell it to data brokers or advertisers. The longer version with full detail follows.
1. Information We Collect
Information You Provide Directly
When you submit a project request, partner application, contact form, or any other form on the Platform, you may provide:
- Contact information: name, phone number, and email address;
- Property information: property address, city, ZIP code, and property type;
- Project details: the surfaces to be painted, project scope, preferred timeline, and any notes you add;
- Business information (Partner Contractor applicants only): business name, years of operation, service areas, crew size, insurance information, and license or certification details;
- Communications: any messages you send through the contact form or by email to us.
Information Collected Automatically
When you visit the Platform, our servers and third-party analytics tools automatically collect certain technical information, including:
- IP address and approximate geographic location derived from it;
- Browser type, operating system, and device type;
- Pages viewed, time spent on pages, and referring URL;
- Date and time of each visit.
This information is used in aggregate to understand how the Platform is used, improve its content and performance, and diagnose technical problems. It is not used to identify you individually.
Cookies and Similar Technologies
We use cookies and similar browser storage technologies to operate the Platform. Specifically:
- Strictly necessary cookies: Required for the Platform to function (e.g., session state, form continuity). Cannot be disabled without breaking core functionality.
- Analytics cookies: We use privacy-respecting analytics to understand aggregate traffic patterns. These do not build individual advertising profiles.
Most browsers allow you to control or block cookies through their settings. Blocking strictly necessary cookies may prevent parts of the Platform from working correctly.
2. How We Use Your Information
We use the information we collect for the following purposes:
- Providing the matching service: Reviewing your project request and identifying an appropriate Partner Contractor to refer to your project;
- Sharing with matched contractors: Transmitting your contact and project details to the Partner Contractor we select for your project so they can reach out about scheduling and pricing — this is the primary purpose of the Platform and a use you explicitly authorize when submitting a request;
- Communicating with you: Sending confirmation messages, following up on your request, and responding to questions you direct to us;
- Evaluating Partner Contractor applications: Verifying the credentials and information provided by contractors applying to the network;
- Improving the Platform: Analyzing aggregate usage data to improve the Platform's design, content, and performance;
- Legal and compliance: Complying with applicable law, responding to legal process, enforcing our Terms of Service, and protecting our rights and the rights of others.
3. How We Share Your Information
With Matched Partner Contractors
This is the core disclosure. When we match you with a Partner Contractor, we share the following information with that specific contractor: your name, phone number, email address, property address, and your project details. This disclosure is necessary for the service and is the one you consent to when submitting a request. We share your information with one contractor at a time, not with all contractors in the network.
With Service Providers
We use third-party vendors to operate the Platform, including cloud hosting, database services, email delivery, and analytics. These vendors access your information only to perform services on our behalf and are contractually required to protect it and not use it for their own purposes.
For Legal Reasons
We may disclose your information if we believe in good faith that doing so is necessary to: comply with applicable law or legal process; protect the safety of any person; prevent fraud or abuse; or protect the rights and property of Painters of Texas.
Business Transfers
If Painters of Texas is acquired, merges with another company, or sells substantially all of its assets, your information may be transferred as part of that transaction. We will notify you of any such change via a prominent notice on the Platform or by email.
What We Do Not Do
- We do not sell your personal information to data brokers, list vendors, or advertising networks.
- We do not share your information with Partner Contractors other than the one matched to your specific request.
- We do not use your project information to target you with advertising on third-party platforms.
4. Data Retention
We retain your submitted information for as long as is reasonably necessary to operate the matching service, fulfill the purposes described in this Policy, and comply with our legal obligations. In practice:
- Project requests: Retained for up to 3 years to support quality assurance, dispute resolution, and program improvement.
- Partner Contractor applications: Retained for the duration of the contractor's participation in the network, plus 2 years after departure.
- Analytics data: Aggregate and anonymized; no fixed deletion schedule.
You may request deletion of your personal information at any time (see Section 7 below). Some information may be retained in anonymized or aggregated form after deletion.
5. Security
We implement reasonable technical and organizational measures to protect the information we hold against unauthorized access, disclosure, alteration, and destruction. These measures include encrypted data transmission (HTTPS), access controls that restrict who within our organization can access personal information, and regular security reviews.
No method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. If you have reason to believe that your interaction with the Platform is no longer secure, please notify us immediately through our contact form or by calling 281-400-2408.
6. Children's Privacy
The Platform is intended for use by adults (18 years and older) entering into business relationships regarding property services. We do not knowingly collect personal information from children under the age of 13. If we learn that we have inadvertently collected information from a child under 13, we will promptly delete it. If you believe we may have received information from a child under 13, please contact us through our contact form or call 281-400-2408.
7. Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal information. Residents of Texas are covered by the Texas Data Privacy and Security Act (TDPSA). The following rights may apply to you:
- Right to Know / Access: You may request a copy of the personal information we hold about you.
- Right to Correct: You may request that we correct inaccurate personal information.
- Right to Delete: You may request that we delete your personal information, subject to certain exceptions required by law or legitimate business need.
- Right to Opt Out of Sale: We do not sell personal information, so this right is not applicable — but you may request confirmation at any time.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.
To exercise any of these rights, submit a request through our contact form with your name and a description of your request, or call 281-400-2408. We will respond within 45 days. We may need to verify your identity before processing a deletion or access request.
8. Third-Party Services and Links
The Platform may link to third-party websites. This Privacy Policy applies only to information collected through the Platform. We are not responsible for the privacy practices of Partner Contractors, linked websites, or any third party you contact as a result of using the Platform. We encourage you to review the privacy policies of any third party before providing them with your information.
9. Do Not Track
Some browsers include a "Do Not Track" (DNT) setting. Because there is currently no industry-wide standard for responding to DNT signals, the Platform does not change its behavior based on DNT settings. We will update this Policy if a recognized standard is adopted.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make changes, we will update the Effective Date at the top of this page. If we make material changes that significantly affect how we handle information you have already submitted, we will provide prominent notice on the Platform or by email prior to the change taking effect.
Your continued use of the Platform after any updated Privacy Policy becomes effective constitutes your acceptance of the revised Policy.
