Terms of Service

Please read these Terms of Service ("Terms") carefully before using PaintersOfTexas.com (the "Platform") or submitting any information through it. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Painters of Texas ("we," "us," or "our"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Who We Are

Painters of Texas operates as a painting contractor referral and matching network, not a painting company. We do not employ painters, hold painting contractor licenses, or provide painting, coating, or surface-preparation services of any kind. Our sole function is to connect Texas property owners, managers, and project stakeholders ("Property Owners") with independent, third-party painting contractors ("Partner Contractors") in our network.

Any work performed, any contract entered into, and any warranty offered is strictly between the Property Owner and the Partner Contractor. Painters of Texas is not a party to that relationship.

2. Eligibility

You must be at least 18 years of age and legally authorized to enter into binding contracts in the United States to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. You may not use the Platform for any purpose that is unlawful or prohibited by these Terms.

3. How the Matching Service Works

When you submit a project request through the Platform, you provide information about your property, the scope of painting work needed, your location within Texas, and your contact details. We review these details and identify up to three (3) Partner Contractors from our network who we believe are qualified and available for your project. We then share your project information with each selected Partner Contractor so they can contact you to arrange a site visit and provide a written bid. Each invited Partner Contractor is required to respond within four (4) hours and submit a hard bid within forty-eight (48) hours of invitation. Partner Contractors who fail to meet these service levels may be replaced.

Key points you should understand before submitting a request:

  • Up to 3 bids, not a marketplace. We send your information to a maximum of three Partner Contractors — not to an open marketplace. Each contractor must respond and bid within the stated timeframes or be automatically replaced.
  • No obligation to proceed. Receiving a match and an estimate creates no obligation for you to hire the Partner Contractor. The decision to engage, contract, and pay for work is entirely yours.
  • Free for Property Owners. The matching service is provided to Property Owners at no charge. Painters of Texas receives a referral fee from Partner Contractors.
  • Geographic scope. The Platform currently serves markets in Texas. Requests from outside our active service areas may not result in a match.

4. Partner Contractor Applications

Painting contractors may apply to join the Painters of Texas network through the Partner Application section of the Platform. Submission of an application does not guarantee acceptance. We reserve the right to accept, reject, or terminate any Partner Contractor's participation in the network at our sole discretion. Partner Contractors who join the network agree to separate terms governing their participation, including insurance requirements, communication standards, and lead response obligations.

5. Authorization to Share Your Information

By submitting a project request or contact form on the Platform, you explicitly authorize Painters of Texasto share the information you provide — including your name, phone number, email address, property address, and project details — with the matched Partner Contractor for the purpose of that contractor contacting you about your project. You also authorize Painters of Texas to contact you by phone, email, or text message regarding your request.

6. No Employment or Agency Relationship

Partner Contractors are independent third parties, not employees, agents, subcontractors, joint venture partners, or representatives of Painters of Texas. Painters of Texas does not supervise, direct, control, or have authority over the methods, schedule, safety practices, or quality of work performed by any Partner Contractor. Nothing in these Terms or in the referral relationship creates an employment, agency, franchise, or partnership relationship between Painters of Texas and any Partner Contractor or Property Owner.

7. Disclaimers of Warranty

THE PLATFORM AND ALL CONTENT, SERVICES, AND FUNCTIONALITY ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Painters of Texas does not warrant:

  • That any Partner Contractor will contact you, complete your project, perform work to your satisfaction, or honor any verbal or written commitment;
  • The accuracy, completeness, or currency of any information provided by Partner Contractors;
  • That Partner Contractors maintain current or adequate insurance, licensing, certification, or any other credential at the time work is performed — even if such credentials were verified at the time of network acceptance;
  • That the Platform will be available, uninterrupted, secure, or error-free at all times.

YOUR USE OF THE PLATFORM AND ANY RELIANCE ON MATCHED PARTNER CONTRACTORS IS ENTIRELY AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAINTERS OF TEXAS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR ANY SERVICES PROVIDED BY A PARTNER CONTRACTOR, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Painters of Texas and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your submission of false, misleading, or inaccurate information; (c) any contract or dispute between you and a Partner Contractor; or (d) your violation of these Terms or any applicable law.

10. User Conduct

When using the Platform, you agree not to:

  • Submit false, misleading, or fraudulent information in any request or form;
  • Use the Platform to solicit contractor relationships outside of the matching process for purposes that circumvent our referral network;
  • Attempt to reverse-engineer, scrape, or otherwise extract data from the Platform in bulk;
  • Interfere with or disrupt the Platform's infrastructure, servers, or networks;
  • Use the Platform for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or services. Painters of Texas has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services. Accessing third-party links is at your own risk.

12. Intellectual Property

All content on the Platform — including text, graphics, logos, images, and software — is the property of Painters of Texas or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be submitted to binding arbitration in Texas under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction for claims involving intellectual property or unauthorized access.

Class Action Waiver: You agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the Effective Date at the top of this page. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, including for violations of these Terms. You may stop using the Platform at any time. Provisions that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and governing law — will survive any termination.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Painters of Texas with respect to the Platform and supersede all prior agreements, understandings, or representations relating to that subject matter.
